Malaysian Indian lawmaker in trouble with government

Kazakhstan News.Net
Sunday 11th May, 2008 (IANS)

Malaysian Indian lawyer-lawmaker Karpal Singh has said he fears for his life following the government's moves to prosecute him for questioning a decision taken by the Sultan of Perak.

Prime Minister Abdullah Ahmad Badawi has said the case against Singh should be expedited if it was to be brought to the court.

'We leave it to the attorney general to decide if he thinks the case could be brought to the court. I hope it would be done quickly because many people are interested to know the ruling on this case,' Badawi told media, The Sun newspaper said Sunday.

Singh accused Badawi, who had instructed secretary-general of the ruling United Malaysian National Organisation (UMNO) Adnan Mansor to lodge a report against him, of 'turning what is purely a legal issue, into a political one with racial undertones'.

A serious confrontation is building up between him and the government after he criticized the Sultan of Perak for stalling the transfer of a high official, who remains in charge of the Islamic religious department.

Following filing of nine reports against him, the police Saturday recorded a statement by Singh, official news agency Bernama said.

He says he stands by his statement questioning Sultan Azlan Shah's action of stalling the transfer of Jamry Suri.

But he maintains that he has not questioned the royalty's prerogative. He has only said that it should not get involved in appointment and transfer of officials.

'It has been, and it is my view that the Perak Sultan had no jurisdiction or power to direct the state government to reinstate Jamry who was a state government servant,' he said, adding that he failed to see why there has been such an uproar over what is purely a legal issue.

Singh, 68, who heads the Democratic Action Party (DAP) was reported as saying that Sultan Azlan Shah had no jurisdiction over the transfer of the official, who had been issued a 24-hour transfer order by Perak's Mentri Besar (chief minister) Mohamad Nizar Jamaluddin April 29.

He warned he would take legal action against the prime minister and deputy PM, Najib Abdul Razak, if they continue making defamatory remarks against him.

'Clearly what I have raised is a purely legal issue and I have in no way questioned the prerogative of the Perak Sultan as head of the religion of Islam in the state as guaranteed in the federal constitution,' he said.

The Bar Council of Malaysia expressed solidarity with Singh, a prominent lawyer, saying it would be wrong to use the sedition charge against him or anyone else for statements critical of the government.

In reality this is a very simple and straightforward case. The MB of Perak while transfering a state servant had erred in customs only. He overlooked the procedures that need to be taken. A call for reinstatement was made by the Sultan. The state government was not fast enough to take the necessary action and exercise damage control. Various parties began to voice out their opinions. Mr. Karpal Singh, whose party is part of the state government, then voiced out his views for the consideration of the State government. The ruling party then sees it appropriate to mount an attack by taking up the issue under the pretex of this and that. Certainly, the Sultan can understand the opinion from Mr. Karpal Singh because of his judicial background. Of course the matter is subject to deliberation or just for academic purposes. But, for the ruling party to spin on the issue is like seeing an opportunist in action trying to act as a hero and to distract their supporters from other more important issues. As such, how can they earn our(the people at large, with no vested interest in politics) respect? how can they win our hearts and minds? I do not see 'good governance' within this context.

Law Tested

I wonder why all irrelevent politicians are jumping into the wagon. My biggest question is why neither Sultan Azlan Shah as former Lord President nor Datuk Zaid Ibrahim, our infamous Law Minister is yet to comment on the issue. Even Raja Nazrin Shah who in recent times issued stinging adresses on good governance is silent on the matter. Looks like Mr. Karpal is right by law and wrong by lawless.

Double Standards

Now that Karpal merely made a point of law, it has been construed as seditious by Barisan 'Nut’sional capers. However, when these goons were disobedient to the rulers of Perlis and Trengganu, it wasn’t the case. The silence from the BN leaders and their stooge(Ibrahim Ali) on this (being rude to Rulers of Perlis and Trengganu) is embarassingly deafening!!

Its this sort of hypocrisy that got them rotten egged in the last elections.

sedition this, sedition that!!

What kind of country has Malaysian turned into communist? Just recently we have a blogger, now, a law maker to be charged under sedition law? Might as well let UMNO declared the country as communist or run by the junta like Burma, then they can do whatever sedition on any one they wish, with no question asked! What about the UMNO law makers thenmselves who questions the authority of the Sultans of Trengganu and Perlis?? To be fair they too should be under the gun! We are living in the 21st century, the citizens are educated and tech savy and we are not to be controlled like kids or robots as they wished. How can we be in the 1st world in 2020? Malaysia boleh or tak boleh???

Is the Perak Sultan more superior than the Agong?

Why is anyone comparing this situation to the case where a few MPs in Terrengganu questioned and if I am not mistaken boycotted the swearing of the Terrenggany MB of the Terrengganu’s Sultan’s choice....infact the Agong’s choice. Is the Perak Sultan in someway more superior to his majesty...the Agong? Or is it because it was done by the UMNOputeras who seem to be immuned to everything they do on the streets?

what???

I question the jurisdiction of anyone who thinks they can prosecute anyone for speaking their mind. Malaysia shows it true colours more and more if one even considers prosecution for a citizen that is just using a basic right of freedom of speech. So I ask??? Does Malaysia believe in “Freedom of Speech”???? Apparently Not!!!!!!! If they have to discuss this Sultan’s actions. Yipes, lets look at this closely. The lawmaker is Indian right???? It may become more clearer to the reader what is really at issure here.

Where is the Sedition?

So what did Karpal Singh say?
"....that Sultan Azlan Shah had no jurisdiction over the transfer of the official, who had been issued a 24-hour transfer order by Perak’s Mentri Besar (chief minister) Mohamad Nizar Jamaluddin April 29."
Is that the issue here?
You don’t need too much intelligence to conclude that there is no Sedition in that statement.
Anyone can question the jurisdiction of anyone, including the royalty similar to the fashion UMNO under Dr. Mahathir Mohammad did during its crisis with the royalty a decade ago.
Right or wrong, justified or unjustified, sedition is crystally absent in Karpal’s statement.

Look at the bigger picture

I am surprised and dismayed that Abdullah is wasting precious time on this seditious issue. Come on, there are many other bigger issues to think about and to implement instead of this small minded issue. For a start, can we have more transparency in all govt agencies, get rid of corruption, more press freedom and the release of all ISA detainees??

If Abdullah wants the AG to rush this to court, then be fair and also bring the UMNO ex-minister who grabbed a woman’s bottom to justice or at least name and shame him in public!

Look at the bigger picture and stop scoring political mileage on this - PM!!

names of Sultan is Parameswaran not Parameswara or Lakshmana

BUDDHIST SRIVIJAYAN WAS FROM"CHOLAMANDALAM COAST OF INDIA” MAY BE FROM BENGAL.
The Sultanate of Malacca was founded by Parameswara in 1402 and later married the princess of Pasai in 1409. Centered in the modern town of Malacca, the sultanate stretched from southern Thailand in the north to Sumatra in the southwest. The Portuguese invaded its capital in 1511 and in 1528, the Sultanate of Johor was established by a Malaccan prince to succeed Malacca.
With the Portuguese and Johor frequently locking horns, Aceh launched multiple raids against both sides in order to tighten its grip on the straits. The rise of Aceh encouraged the Portuguese and Johor to sign a truce and divert their attention to Aceh
